Welcome to indovator.com (website) where you may avail facilities provided by International Centre for Technological Innovations, a Society registered in Kerala India under Travancore-Cochin Literary, Scientific and Charitable Societies Registration Act XII, 1955 and the owner of this website. From here onwards in this agreement, the term “Indovator” refers to the website indovator.com and International Centre for Technological Innovations who owns this website. This Terms and Conditions of Service (“Agreement”) between Indovator and users of the website (“You”) describes the terms on which Indovator offers you the Services (as defined below) through the website. The use of this website is governed by the terms and conditions under this Agreement. Before using this website, you must carefully read, understand, accept and agree to abide by all the terms and conditions under this Agreement. If you do not agree to these terms and conditions under the Agreement, please do not use the website.
Indovator reserves the right to revise, amend or modify this terms and conditions of service at any time and in any manner as it may deem fit. Any change or revision so effected will be posted on the site. It is therefore important that you review these terms regularly to ensure you are updated as to any changes.
1. Description of Indovator services
The facilities and services provided by Indovator are as follows,
1.1 Funding services: Indovator is an educational initiative to enhance skills of individuals in sustainable development, innovation and social entrepreneurship. Users can use the facility of Indovator for making donations to International Centre for Technological Innovations. The donations will be utilised for providing grant support to the project activity(ies) of participating individuals.
1.2 Payment Gateway: If you are making donations through the payment gateway, you understand that the payment gateway is provided by a third party and governed by the terms and conditions provided by such third party. You are liable in the event you violate any of the terms and conditions of such third party in making your donations. Indovator shall not be responsible for any such errors or default in making your donations.
1.3 Indovator Awards: Certificate of Awards will be offered to individuals who receive support from donors expressing interest in their project, and such selected individuals will be recognised as Indovator Award winners.
1.4 Utilization of donations and Feedback reports: You understand that Indovator utilises the donations to merely offer grants to youth who are responsible for implementing the project. Indovator strives to provide a feedback report on the utilization of donations made by you within reasonable time limits. The feedback report time period may vary depending on the nature of utilization of donation.
1.5 Tax exemption certificates: Within reasonable time limits International Centre for Technological Innovations will provide applicable tax exemption receipt to donor of Indovator upon receiving a request.
2. Donor Information
2.1 Before making any donation, you are required to fill all the mandatory information in the online form. This information will be used for further communication in terms of feedback, reports, etc. We will also collect additional information and copy of id-proofs like PAN, etc. from donors requesting tax exemption receipts. And also note that this is required as per Government of India order to record all the information about the donors.
2.2 You acknowledge that all information submitted by or on behalf of you are true to the best of your knowledge. Indovator shall take reasonable steps to maintain the confidentiality of such information. However, Indovator does not assume any liability in case of any direct or indirect loss, injury, claim, liability or damages of any kind whatsoever arising on account of divulgence of such personal information by any third party user.
2.4 By accepting this Agreement, You agree that you are responsible for all information provided and subsequent activities carried by you on the website.
3. Project Information
3.1 Indovator enlists projects of individuals to be a part of this platform after screening their activities on a best effort basis. Indovator has the sole discretion to enlist/delist projects.
3.2 Some of the content on the website is provided by various individuals whose projects are enlisted. Copyright of such content will remain exclusively with the individuals. Indovator does not assume any responsibility for the mistakes which might appear in such content.
4.1 You can donate to Indovator using a number of payment methods such as credit or debit cards or cheque. Donations are processed by our payment gateway service provider Instamojo.
4.2 All donations made through Indovator are NON-REFUNDABLE. Please contact Indovator within 3 days of payment, if there are justifying reasons or circumstances for refund and your case may be reviewed on a best effort basis and decision of Indovator will be final.
4.3 You will receive an email confirming your donation to the cause. This is the final confirmation of your donation. If you have not received please contact Indovator immediately.
4.4 Donations are used for providing grants to Indovator award winners who achieve a minimum targeted crowdfunding. You may express support for a project. However, Indovator would provide grant to teams that are able to implement the project.
4.5 Indovator reserves the right at any time from time to time to modify or discontinue, temporarily or permanently the donation facility with or without notice.
5. Prohibited Activity
5.1 You agree to act in a responsible and legal manner when using the Indovator Services. You shall comply with all applicable laws, regulations and rules and undertake not to use the Indovator Services for any unlawful purpose or in a manner which is likely to cause harm or offense to any other user including Indovator.
5.2 You agree not to post content that is patently offensive and promotes racism, bigotry, hatred or harm of any kind against any group or individual.
5.3 You agree not to create a false identity on the website, impersonate any person or entity (including members of Indovator) or falsely state or otherwise misrepresent yourself, your name, or your affiliation with any person or entity.
5.4 You agree not to submit or transmit through any material that contains viruses or any other computer codes, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, or otherwise permit the unauthorized use of a computer or computer network.
5.5 Indovator reserves the right to investigate and take appropriate legal action against anyone who, in Indovator’s opinion, violates this provision, including, without limitation, reporting you to appropriate law enforcement authorities.
6.1 You are solely responsible for the content that you post on or through any of the Indovator Services, and any material or information that you transmit to other users. Indovator will not be liable and does not endorse and has no control over such content.
6.2 All trademarks reproduced in this website, which are not the property of, or licensed to Indovator, are acknowledged on the website.
6.3 Through this website links to other websites are provided for your convenience to provide further information and they are not under the control of Indovator. We have no control over the nature, content and availability of those websites.
7. Intellectual property rights
7.1 Unless otherwise stated, Indovator or our third parties own the intellectual property rights in the website and material on the website.
7.2 You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.
7.3 Indovator grants you a personal, non-transferable and non-exclusive right and license to use the services; provided that you do not (and do not allow any third party to):
a) Sell, rent or sub-license material from the website;
b) Show any material from the website in public, without accreditation of the source;
c) Reproduce, duplicate, copy or otherwise exploit material on Indovator website for a commercial purpose;
d) Edit or otherwise modify any material on the website.
8.1 Indovator aspires to be a dynamic website by adding new features and content regularly for the benefit of visitors. For this purpose Indovator website may be temporarily shut down for updation work. However, Indovator will put its best efforts to minimize the inconvenience caused due to non-availability of website.
8.2 At Indovator we make every effort is made to keep the website up and running smoothly. However, Indovator takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to issues beyond our control.
9.1 By accepting these Terms, you agree to indemnify and otherwise hold harmless Indovator, its officers, employees, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages resulting from the use of the Indovator Services by you or by those who have access to the service through your account.
10. Privacy and Disclosure
10.1 We collect non-public personal information about you from the following sources: Information we received from you on the applications or other forms, such as your name, address, etc. Your contact details may be shared with our affiliates, sponsors and other third parties to offer you their content or services. You understand and agree that Indovator may disclose personally identifiable information if required to do so by law or in the good faith belief that such disclosure is necessary to comply with legal process, enforce these terms or protect the rights, property or safety of Indovator, its members and the public
11. Governing Law/Dispute Resolution
11.1 This Agreement shall be governed in accordance with the laws of India and the Courts in Alappuzha shall have the exclusive jurisdiction to try and suit, proceedings in connection therewith/in that behalf. Any disputes under this agreement, which cannot be settled by negotiation may be resolved exclusively by arbitration and shall be held in Alappuzha, India and conducted in accordance with the provision of Arbitration and Conciliation Act, 1996 or any statutory modification or re-enactment thereof. Subject to the above, the courts of law at Alappuzha alone shall have the jurisdiction in respect of all matters connected with the agreement. The arbitration award shall be final and binding.
12. Crowdfunding and Disbursement of Grant
12.1 Any amount of crowdfunding received for a project will be disbursed as grant to the project team subject to conditions listed below. Grants are provided with the expectation that project team will apply the fund towards implementing the project and for activities including testing, refining and scaling their solution.
12.2 Administrative Charges: 10% of crowdfunding will be deducted towards administrative charges. In addition online payment gateway fees, processing cost, and bank charges will be deducted. The amount will be deducted in advance prior to disbursement of grant.
12.3 Grant will be disbursed to all who have raised a minimum of Rs 2500. Any amount less than that cannot be meaningfully used for project activities.
12.4 Utilisation of Grant: The money provided as grant must be utilised for following activities in below listed order of priorities:-
1) Research Grant Application: Preparing detailed project proposal for receiving grant for product development from government agencies and foundations.
2) Business Plan: Writing business plan including detailed project report for availing funding from banks, angel investors and financial institutions for project commercialisation and setting up a business.
3) Technology Demonstration and Transfer Workshop: Organising workshop for prospective entrepreneurs, self-help groups, producer organisations, NGOs and/or SMEs, to create awareness about the project and its socio-economic benefits. The workshop would help identify early adopters and create opportunities for technology transfer and commercialisation.
4) Video Making: Developing promotional video about the project.
5) Prototype Development: Create working prototype of the project, especially a commercially valuable product.
6) Intellectual property protection, patenting, obtaining certifications and business registrations.
To achieve the best outcome, it is expected that the project activities must be carried out under close supervision of Indovator and mentors assigned.
The maximum expenses allowed under each items are listed below:
Research Grant Application: Rs. 2000
Business Plan: Rs 2000
Technology Demonstration and Transfer Workshop: Rs 5000
Video Making: Rs 3000
Prototype Development: As per actual expenses
IPR, Certifications and Business Registration: As per actual expenses
12.6 Disbursement of Grant: Project team must submit an activity plan for project implementation including technology commercialization and schedule of utilization of fund. The grant money will be credited to bank account given by the project team. It will be released in three instalments and reimbursement basis.
12.7 Reports to be submitted: Monthly Progress Report giving information about current status of the project must be emailed by end of every month. After completing the project you must submit via email a Project Completion Report which includes grant utilization, photos and/or videos of the project and technology commercialization/transfer and details of beneficiaries. This report and documentation will be given to all donors.
13. Matching Fund
13.1 As part of the Awards, through our sponsors, Indovator aims to provide matching fund for training in commercial scale-up to innovators who raise Rs.25,000 in crowdfunding.
13.2 The maximum matching fund allocated per team will be Rs.25,000 covering the training expenses of a team of up to five members at rupees five thousand each.
13.3 The matching fund will be directly utilised or disbursed to our associates and training partners, towards the tuition fees of training programme organised. No TA and DA will be covered.
13.4 Decisions regarding curriculum, content, date, duration and venue of training will be decided only by Indovator, and the decision will be final.
13.5 It will be mandatory for all teams selected for training to attend the programme prior to disbursement of grant.
14. Declaration of Award Winners
14.1 The minimum crowdfunding target for receiving any Indovator Award Certificate is Rs.5000
14.2 The project team that receives the highest crowdfunding will be declared as winner of the Indovator Award - Outstanding Social Commitment Award.
14.3 Additionally 8 other highest crowdfund raisers will receive the Sustainability Leadership Award
14.4 In case of a tie winner will be chosen based on number of donors supporting the project
14.5 In the event of a further tie winner will be chosen on the basis of categories
